Privacy Statement

This Privacy Statement describes the information Vengeo collects from you as part of the normal operation of Vengeo services and what may happen with that information.

The privacy practices of this statement apply to Vengeo services available under the domain and sub-domains of www.vengeo.com (the "Site). By visiting this website you agree to be bounded by the terms and conditions of this Privacy Statement. If you do not agree, please do not use or access the Site.

By accepting the Privacy Statement, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Statement. This Privacy Policy is incorporated into and subject to the terms of the Vengeo User Agreement (also referred to as Terms & Conditions). This Privacy Policy is effective upon acceptance at time of registration for new registering users.

1. AN IMPORTANT NOTE ABOUT CHILDREN

Children (persons under the age of 14) are not eligible to publish PiP-Catalogues for view and upload to the Site and we ask that children do no submit any personal information to us. We strongly recommend that children use or access the Site only in conjunction with and under the supervision of parents or guardians. Although we will make every attempt to enforce our Privacy Statement to other users, we cannot guarantee that content will be screened and removed in a timely manner.

2. INFORMATION WE COLLECT

The primary purpose in collecting personal information from you is to provide you with a safe, smooth, efficient and customized experience. This allows us to provide services and features that most likely meet your needs. We only collect personal information about you that we consider necessary for achieving this purpose.

If you choose to use the Site, we may require you to provide contact and identity information, billing information, demographic information and other information as indicated on the forms throughout the Site. Where possible, we indicate which fields are required and which fields are optional. You always have the option to not provide information by choosing not to use a particular service or feature.

Under some circumstances, Vengeo requires additional financial information. We use your financial information to verify the accuracy of your name, address, and other information, as well as to bill you for the use of Vengeo services.

Do not disclose information to a Vengeo staff person without first determining the validity of that request! Vengeo only authorizes Vengeo staff people to request information that is directly used to service your Vengeo membership, but Vengeo cannot guarantee that Vengeo staff will not abuse this authority. You release Vengeo of all liability of harm or damages caused if such an event occurs.

Vengeo automatically tracks certain information about you based upon your behaviour on the Site. Vengeo uses this information to identify PiP-Catalogues to include in your email notification and to develop statistics on Vengeo users' demographics, interests and behaviour. These statistics are used for internal research and shared only in summary form with Vengeo Members. This information may include but not limited to the URL that you just came from (whether this URL is on Vengeo Site or not), which URL you next go to (whether this URL is on Vengeo Site or not), your computer browser information, and your IP address.

For users (visitors) that arrive at Vengeo.com via a Vengeo logo (or other method) embedded as a link at another company's website (unrelated to Vengeo) which results in a pop-up of the Vengeo Online Viewer, and whereby during that session, within the Vengeo Online Viewer the visitor either registers to Vengeo via the Vengeo Online Viewer or while in the Viewer then links to the Vengeo website to register at the Vengeo website, information about the user resulting from their registration to Vengeo during the session will be provided to the introducing website that directed the user to Vengeo. All user information collected about that user during the session's registration, and any future update of said user information may be supplied in whole or in part to the introducing website.

If you choose to register an account with Vengeo through an "Organization" then that "organization" will have access to and may view your account information, any and all publications you may produce as well as any other information related to your account and/or your activity at Vengeo and you do so at your own risk and hereby release Vengeo from any responsibility or damage resulting from its use.

We will not knowingly ever release your personal information, address, or phone number unless you have specifically requested us to do so on various forms throughout the Site.

If you purchase a non-free Vengeo Membership Plan (Plans 2 to 7), Vengeo collects additional information, such as: a billing address, credit card number and credit card expiration date and tracking information from cheques/checks or money orders.

If you send us personal correspondence, such as emails or letters, we may collect such information into a file specific to you.

Vengeo uses data collection devices such as "cookies" on certain pages of the Site to help analyse our web page flow, measure promotional effectiveness, and promote trust and safety. "Cookies" are small files placed on your hard drive that assist us in providing our services. Most cookies are "session cookies," meaning that they are automatically deleted at the end of a session. You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on our Site and you may be required to re- enter your password more frequently during a session.

3. OUR USE OF YOUR INFORMATION

Vengeo uses your personal information to facilitate the services you request. We use personal information in the file we maintain about you, and other information we obtain from your current and past activities on the Site to: resolve disputes; troubleshoot problems; bill your account; help promote safe trading; measure member interest in our services and our advertisers' services, inform you about online and offline advertiser offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our User Agreement; select PiP-Catalogues to notify you; provide statistical information to Vengeo Members; and as otherwise described to you at the time of collection. At times, we look across multiple users to identify problems or resolve disputes, and in particular we may examine your personal information to identify users using multiple User ID's or aliases. We may compare and review your personal information for errors, omissions and for accuracy.

You agree that we may use personal information about you to improve our marketing and promotional efforts, to analyze Site usage, to permit our advertisers to display their ads on your PiP-Catalogues depending on the Vengeo Membership Plans (All Vengeo Membership Plans will have varying degrees of control of advertisers based on Vengeo's discretion and schedule), to improve our content and product offerings, and to customize the Site's content, layout, and services. These uses improve the Site and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe and customized experience while using the Site.

You agree that we may also use your personal information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as targeted banner advertisements, targeted email notifications, administrative notices, product offerings, and communications relevant to your use of the Site.

You agree that we may also include your demographic information and web browsing behaviour on the Site as a part of statistics released to Vengeo Members. We will not release personal information to Members or other members that may compromise this agreement.

Also, upon termination of your account (membership) at Vengeo, by yourself or by Vengeo, your activity history is retained to provide you with the ability to later resurrect your account, but also, to comply with legal requirements as is permitted by law. However, such personal information will be deactivated from public and member viewing and will only be available to select Vengeo personnel.

4. OUR DISCLOSURE OF YOUR INFORMATION

Advertisers: We aggregate (gather up data across all user accounts) personal information and disclose such information in a non-personally identifiable manner to advertisers and other third parties for their marketing and promotional purposes. However, in these situations, we do not disclose to these entities any information that could be used to identify you personally. Certain information, such as your name, email address, password, and financial information are not disclosed to these third parties in a personally identifiable manner without your explicit written consent. Vengeo will never ask you for permission to do so over the telephone.

Vengeo Community: If you make PiP-Catalogues available for viewing and download, your Vengeo "Alias" or "Short Name" or "Contact Info" from your registration, may be displayed in accordance with this Privacy Statement, and therefore may be available to the public. If you make your personal information available in your PiP-Catalogues, the personal information also becomes available to the public. We also provide a number of ways for other users to search for you or your PiP-Catalogue.

Activity on the opening and viewing of your PiP-Catalogue is tracked to provide you with a measure of the popularity of your PiP-Catalogue; Reports are made available to you within your Vengeo Account. This information will also be available to advertisers and members. However, none of the publisher's personal info or the viewer's personal information will be made available to advertisers unless the Member has explicitly made it public from the initial registration or updated in the My Account page.

From time to time, we may send out notices to you or other community members regarding suspicious activity or policy violations on the Site.

It is also possible for you to supply your PiP-Catalogue link in any number of web locations, other than at Vengeo. It is also possible for Vengeo members and non-members to copy/paste your PiP-Catalogue links, or any Vengeo page or your Vengeo Profile Page link to any other web page outside of Vengeo. In those instances Vengeo cannot control or prevent the viewing or display of your content or private information, unless you explicitly delete the PiP-Catalogue at Vengeo, or request Vengeo to do so.

Legal Requests: Vengeo cooperates with law enforcement inquiries, as well as other third- parties to enforce laws such as: intellectual property rights, fraud and other rights, to help protect you and the Vengeo community from criminals. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can (and you authorized us to) disclose your name, city, province, telephone number, email address, UserID history, fraud complaints, and activity history without a subpoena. Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from criminals, we will not otherwise disclose your personal information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to: prevent imminent physical harm or financial loss; or report suspected illegal activity.

Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect from the Site. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

5. YOUR USE OF OTHER USER'S INFORMATION

In order to facilitate interaction among Vengeo Members, our Site provides you with limited access to other Vengeo Members' contact information. As a Member you have access to Vengeo member names and any additional information provided by the Vengeo member on his/her PiP- Catalogue, Descriptors, or Profile Page.

You agree that, with respect to other users' personal information that you obtain through the Site or through Vengeo-related communication, Vengeo hereby grants to you a license to use such information only for: (a) Vengeo-related communications that are not unsolicited commercial messages, (b) using co-branded services offered through Vengeo (e.g. fraud complaints), and (c) any other purpose that such user expressly agrees to after you tell them the purpose you would like to use it for. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances, except as defined in this Section, can you disclose personal information about another user to any third party without Vengeo consent and the consent of that user.

You agree that other users may use your personal information to communicate with you in accordance with this Section. Note that law enforcement personnel, and other rights holders are given different rights with respect to information they access.

Vengeo and Vengeo Members do not tolerate spam. Therefore, without limiting the foregoing, you are not licensed to add a Vengeo Member, even a user who has downloaded your PiP- Catalogue and purchased merchandise from you, to your mail list (email or physical mail) without their express consent.

6. CONTROL OF YOUR PASSWORD

You are responsible for all actions taken with your User ID and password, including fees charged to your account. Therefore, we do not recommend that you disclose your Vengeo password to any third parties. If you choose to share your User ID and password or your personal information with third parties, you are responsible for all actions taken with your account and therefore you should review that third party's privacy policy before doing so. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password as detailed in Section 7, below.

Because it is possible to add security access (UserID and password) to the opening of your PiP-Catalogues, as well as the ability to add the same type of security access to your Forms, we cannot control the distribution or use of those userIDs and/or passwords. Vengeo will ensure that these are maintained in a database table, unencrypted, for relative ease fr your review and maintenance, however, you are solely responsible for the distribution, and as such, it is possible for the misuse and non-intended distribution of that security information.

7. ACCESSING, REVIEWING AND CHANGING YOUR PERSONAL IDENTIFIABLE INFORMATION

We offer you the ability to automatically review and change the personal information you submit to us by logging into the Site and entering the new information yourself. Generally, we will not modify your personal information based upon your request because it is very difficult to authenticate your account manually. You must promptly update your information if it changes or is inaccurate.

Upon your request, we will deactivate your account, contact information, billing information, shipping information and financial information from our active databases. Such information will be deactivated as soon as reasonably possible based upon your account activity and in accordance with our deactivation policy and applicable law. Vengeo will not completely refund purchased Vengeo Membership Plans. Please see the End User License Agreement for details.

We will retain in our files some personal information you have requested to remove to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our End User License Agreement and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information will be completely removed from our databases in response to your requests. However, such personal information will be deactivated from public and member viewing and will only be available to select Vengeo personnel.

8. NOTICE

Vengeo may amend this Privacy Statement at any time by posting the amended terms on the Site. All amended terms shall automatically be effective 30 days after they are initially posted on the Site.

9. ACCOUNTABILITY
